Terms and Conditions of Cristina Mila Online Store

1. General provisions

1.1. These Terms and Conditions ("Terms") are approved and agreed by the Customer by visiting and purchasing products on the online store at www.cristinamila.com ("Cristina Mila Online Store"). The Terms determine the rights and obligations of the parties, terms and conditions for the purchase and payment of the products, their delivery and return, liability of the parties and other provisions relating to the purchase of products on Cristina Mila Online Store.

1.2. The products on Cristina Mila Online Store are manufactured and offered for sale by Kristina Mila UAB ("Seller"). Information about the Seller's company, phone and e-mail address at which the Customer can contact the Seller are specified in the "Contact" section of Cristina Mila Online Store.

1.3. The Seller reserves the right to change the Terms at any time. Before making each order, the Customer may again access the Terms. The purchase is governed by the Terms as valid at the time of making an order.

1.4. Cristina Mila Online Store offers products for sale only in countries specified in the terms of delivery. For the purchase and delivery of products in other countries, please contact us by e-mail.

1.5. Cristina Mila Online Store offers products for sale only to consumers who purchase them for their consumption purposes and who have reached the age of majority under the law of their place of residence, have the right to dispose of their income independently and their legal capacity is not restricted by law.

1.6. Prices at Cristina Mila Online Store apply as indicated at the time when the order is submitted to the Seller. They may at any time be changed by the Seller for future orders. Value added tax is included in the price. The transportation costs can be seen by choosing the delivery method as described in Section 9 of the Terms.

1.7. The Terms are prepared and published in the Lithuanian language, together with their translation into English. The Seller strives to ensure, to the maximum extent possible, that the translation conforms to the Terms in the Lithuanian language. Nevertheless, in case of discrepancies between the Terms and their translation into English, the Terms in the Lithuanian language shall prevail.

2. Protection of personal data

2.1. The Customer may choose between two ways to place an order on Cristina Mila Online Store:

2.1.1. by registering on this website by entering their login name and password;

2.1.2. without registering on this website.

2.2. When placing an order the Customer shall indicate, in the relevant fields, their personal data necessary for the correct fulfilment of the order: first name, surname, delivery address, phone number and e-mail.

2.3. By accepting these Terms, the Customer agrees that their personal data will be processed for the purpose of selling the products on Cristina Mila Online Store.

2.4. By accepting that their personal data are processed for the purpose of selling products on Cristina Mila Online Store, the Customer also agrees that the Seller may send, to the e-mail and phone number indicated by the Customer, information that is necessary for the fulfilment of the Customer’s orders.

2.5. The Customer may also wish to subscribe to the newsletter of Cristina Mila Online Store. The newsletter is sent by the Seller to the e-mail indicated by the Customer. The Customer may unsubscribe from the newsletter by contacting the Seller via e-mail.

2.6. The personal data provided by the Customer is processed solely for the purpose of selling products on Cristina Mila Online Store and to address the Customer's queries. The Seller undertakes not to disclose the Customer's personal data to third parties, except the Seller's partner undertakings which provide delivery services or other services necessary for the fulfilment of the Customer's orders. In all other cases, the Customer's personal data may be disclosed to third parties only in accordance with the rules set out in the legal acts of the European Union and the Republic of Lithuania.

2.7. Personal data relating to the Customer's orders are processed for 5 (five) years from the date of the order. Personal data relating to queries that are not related to specific orders are processed for 1 (one) year. In the event of disagreement or the possibility of such disagreement regarding an order or query, the Seller has the right to retain the data for a longer period, until the expiry of the legally prescribed time period for lodging a complaint or claim or until the final decision of the court or another dispute settlement body.

2.8. The Seller does not seek to collect or process data on persons who, under the law of their place of residence, are considered to be minors. In the event of any questions as to whether the Seller has been provided with such information, please contact the Seller by e-mail.

2.9. The Seller may use cookies or other technological tools that are transferred to the Customer's computer or mobile device while visiting Cristina Mila Online Store and stored in the Customer's browser. In this way, the Customer is recognised by Cristina Mila Online Store, the Customer is given the opportunity to see the orders and the Seller can identify which pages of the online store and the products on offer the Customer has reviewed. This allows the Seller to provide more convenient browsing, make suggestions to the Customer and analyse the Customers’ behaviour and improve Cristina Mila Online Store and the services provided by it. Cristina Mila Online Store may also use third-party technical tools that allow third parties to see what products the Customer is interested in, which websites they visit, thereby giving the Seller the opportunity to advertise its products to the Customer also on other websites.

3. The moment of the conclusion of the contract of sale

3.1. The contract between the Customer and the Seller is considered to be concluded from the moment when the Customer, having chosen the product and placed it in the shopping cart, clicks on the "Order" link, and the Seller sends the confirmation of the order to the Customer via e-mail.

3.2. The Seller has the right to cancel the submitted orders if the Customer does not make the payment for the ordered products within 24 hours from the Seller's confirmation of the order. The procedure for payment for products is set out in Section 8 of these Terms.

3.3. Each contract for the purchase of products concluded between the Customer and the Seller is registered and stored in the database of Cristina Mila Online Store.

4. Customer's rights

4.1. The Customer has the right to purchase products on Cristina Mila Online Store in accordance with the rules set out in these Terms and in other sections of the Seller's Online Store.

4.2. The Customer has the right to access their personal data and the right to request the correction of incorrect, incomplete, inaccurate personal data by submitting such request to the Seller via e-mail or contacting the Seller by phone.

4.3. In accordance with the rules specified in Section 11 of the Terms, the Customer has the right to cancel the order prior to dispatch of the products and to return received products by withdrawing from the contract concluded on Cristina Mila Online Store.

5. Customer's obligations

5.1. The Customer undertakes to pay for the products and accept them in accordance with the Terms.

5.2. By registering with Cristina Mila Online Store the Customer undertakes not to transfer their login data to third parties. In case the Customer loses their login information, the Customer shall immediately inform the Seller by e-mail.

5.3. If the data submitted by the registered Customer change, the Customer shall immediately update them.

5.4. When submitting a written notice of withdrawal from the contract, the Customer shall return the product no later than within 15 (fifteen) calendar days (if it has been delivered to the Customer) at the Seller's address, which is specified in the "Contacts" section of Cristina Mila Online Store.

5.5. When using Cristina Mila Online Store, the Customer undertakes to comply with these Terms and other rules clearly stated in the online store and not to violate applicable laws.

6. Seller's rights

6.1. The Seller has the right, at its own discretion, to determine the minimum size of the shopping cart, i.e. the minimum amount upon which the Customer's order will be fulfilled. The minimum size is visible when viewing the shopping cart.

6.2. If the Customer attempts to harm the stability and security of Cristina Mila Online Store or fails to fulfil their obligations, the Seller is entitled immediately and without notice to restrict or block the Customer's access to the online store or to cancel the Customer's registration or to block access to the online store from certain IP addresses.

6.3. The Seller is entitled without notice to the Customer to cancel their order if the Customer does not make the payment for the ordered products within 24 hours from the Seller's confirmation of receipt of the order as provided for in Section 8 of the Terms.

7. Seller's obligations

7.1. The Seller undertakes to provide the Customer with the possibility to use the functions and services of the online store in accordance with the Terms and the rules stated in the online store.

7.2. The Seller undertakes to respect the Customer's rights to their personal data, i.e. to process personal data indicated by the Customer only in accordance with the rules set out in Section 2 of the Terms and in accordance with the legal acts of the European Union and the Republic of Lithuania.

7.3. The Seller undertakes to deliver the products ordered by the Customer to the address indicated by the Customer in accordance with the conditions specified in Section 9 of the Terms.

7.4. If the Seller is unable, due to important circumstances, to deliver the products ordered by the Customer, it undertakes to offer an analogous product or a product that is as much comparable as possible to the one ordered by the Customer. In case the Customer refuses such an offer, the Seller undertakes to return the funds paid by the Customer within 5 (five) business days.

7.5. If the Customer exercises the right of withdrawal under Section 4.3 of the Terms and in compliance with the rules for the return of products as foreseen in the Terms, the Seller undertakes to return the funds paid by the Customer within 10 (ten) business days from the date of receipt of the returned products and the Seller's confirmation that the products have been received.

8. Payment

8.1. Payment via PayPal

When submitting the order, you can choose to make the payment through the PayPal system. At the end of the process you will be directed to the system www.paypal.com where you can choose a suitable payment method. For more information, visit www.paypal.com.

8.2. Payment via Paysera

When submitting the order, you can choose to make the payment through the Paysera system. At the end of the process you will be directed to the system www.paysera.lt where you can choose a suitable payment method.

8.3. Payment via Cardinity

When submitting the order, you can choose to make the payment through the Cardinity system. At the end of the process you will be directed to the cardinity.com where you can choose a suitable payment method.

9. Delivery of products

9.1. When ordering the products the Customer can choose the method of transportation, i.e. to have the Seller to deliver the products via Lithuanian Post or DPD courier.

9.2. Delivery of products to the Customer:

9.2.1. Having chosen the method of transportation when submitting the order, the Customer undertakes to indicate the exact place of delivery of the products.

9.2.2. The Customer undertakes to accept the products in person. In the event that the Customer cannot accept the products in person and the products have been delivered to the address and on the basis of other information provided by the Customer, the Customer is not entitled to claim that the products have been delivered to the wrong person.

9.2.3. Products are delivered by the Seller or its authorised representative.

9.2.4. Delivery of products (transportation) in the territory of the Republic of Lithuania and other countries specified in the terms of delivery is subject to the delivery costs.

9.2.5. Products are delivered in the territory of the Republic of Lithuania and in other countries specified in the terms of delivery.

9.3. The Customer can see the delivery costs at the second step in the processing of the shopping cart when choosing one of the delivery methods.

9.4. The Seller delivers the products to the Customer in accordance with the timelines specified in the product descriptions. These timelines are preliminary and also do not apply in cases where the products are not available at the Seller's warehouse and the Customer is informed about the unavailability of the ordered products. In addition, the Customer agrees that, in exceptional cases, the delivery of the products may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to contact the Customer immediately and to agree on the conditions for the delivery of the products.

9.5. In any event the Seller’s liability is excluded if the delivery fails or is delayed due to the fault of the Customer or due to circumstances within the Customer’s control.

9.6. On the delivery of the products to the Customer, the Customer shall, together with the Seller or its authorised representative, check the condition of the parcel and the product and shall sign the acceptance document. Upon signature by the Customer in the acceptance document, it is considered that the parcel and the products are in good condition, the products are not damaged (except for any damages that may have been be caused at the manufacturing stage) and the product has been delivered in full (to the extent this can be determined when inspecting the product). In case the Customer notices that the packaging or the product has been damaged and/or the product is not complete, the Customer shall indicate this in the acceptance document and, in the presence of the Seller or its representative, prepare a document noting the damage and/or missing items. Failure to do so shall release the Seller from liability to the Customer, unless the product has been damaged at the manufacturing stage. The Seller shall also not be liable for missing items if this could have been detected when inspecting the product upon its delivery.

10. Quality of products

10.1. The characteristics of the products offered on Cristina Mila Online Store are included in general terms in the description of each product.

10.2. The Seller is not responsible for the potential mismatches between colour, shape or other parameters of the product as shown on Cristina Mila Online Store and the actual size, shape and colour of the product, to the extent this is caused by the characteristics of the monitor used by the Customer.

10.3. The Seller provides a warranty for all products in accordance with the legal acts of the Republic of Lithuania.

11. Cancellation of the order, return and replacement of the goods

11.1. The Customer has the right to return the purchased products within 14 (fourteen) calendar days from the date of delivery. If you would like to return the products, please contact us and we will change the product without any further cost to another analogous product of, for example, a different size, or we will refund the money paid for the product, including the cost of its delivery to you. When returning or changing the products, the Customer is responsible for the costs of their delivery to the Seller. If you would like to change the product to a different one, please return the purchased product in accordance with the rules for their return and place a new order on this website.

11.2. If the products have been manufactured according to the Customer’s individual order or have been clearly adapted to it, they may not be returned or changed. The Customer is not refunded for the payment of such products.

11.3. In order to return the product as foreseen in Section 11.1 of the Terms, the Customer shall inform the Seller by e-mail using the template below. Usually, the request for the return of the products is processed within 48 hours of receipt.

11.4. In order to return or change the products, the Customer shall also comply with the following requirements:

11.4.1. the returned product must be in the original and orderly packaging;

11.4.2. it is permitted to replace the products with other products or to return them if the products have not been used and are in good condition and if the products, labels and packaging are not damaged. The Customer shall ensure that a product in good condition is not damaged and product packaging is not changed. Changes made to the appearance of the product or its packaging, which were necessary to inspect the product, are not considered to be essential changes to the appearance of the product. When returning products or replacing them, you need to return any protective cover in which the products have been delivered. In all possible cases, the original packaging shall be used;

11.4.3. the product shall not be used, it has not lost its marketable appearance (labels are intact, protective layers not removed, etc.);

11.4.4. a product in good condition must be the same as the one received by the Customer.

11.5. The Seller has the right not to accept the products returned by the Customer and/or to offer refund if the Customer has not complied with the requirements for the return of products specified in Sections 11.3 and 11.4 of the Terms.

11.6. Products are exchanged or returned when the Customer delivers the products to the Seller's office at the address indicated in the "Contacts" section.

11.7. The refund for returned products shall be made to the Customer within 10 (ten) business days from the date of returning the products to the Seller and the Seller’s confirmation that the products have been accepted as returned. We do not accept liability for lost returns.

11.8. The cost of the return of products shall be paid by the Customer.

11.9. If you wish to cancel or change the order before the products are dispatched, please contact the Seller by e-mail. If the products have already been dispatched, the Customer can use the opportunity to withdraw from the contract and return the products in accordance with the rules set out in this Section.

12. Liability

12.1. The Customer is responsible for the accuracy of the personal data submitted by them. If the Customer fails to provide accurate personal data, the Seller is not liable for the consequences arising therefrom and has the right to demand from the Customer the compensation of direct losses.

12.2. A registered Customer shall be liable for any transfer of login data to third parties. If a third party uses the functions and services provided by Cristina Mila Online Store, by accessing the online store using the Customer's login details, the Seller considers this person as the Customer.

12.3. The Seller’s liability is excluded in cases where the loss arises from the fact that the Customer, despite the Seller's recommendations and the Customer’s obligations, did not take the opportunity to review the Terms carefully.

12.4. If there are links to other websites on Cristina Mila Online Store, the Seller is not responsible for the information contained therein or activities pursued on them, those websites are not supervised or controlled by the Seller, and the Seller does not represent them.

12.5. In case of damage, the party at fault shall compensate the other party for direct losses.

12.6. The Seller is not responsible for the proper fulfillment of obligations between the Customer and the Seller's partner undertakings, whose services are ordered by the Customer.

13. Exchange of information

13.1. The Seller shall send all messages to the e-mail provided by the Customer in accordance with Section 2.2 of the Terms.

13.2. The Customer shall send all messages and questions to the e-mail and other contact details indicated in the "Contact" section of Cristina Mila Online Store.

14. Final provisions

14.1. The Terms and the relationship arising from the use of Cristina Mila Online Store are governed by the laws of the Republic of Lithuania.

14.2. If a disagreement between the parties cannot be resolved, the Customer may lodge a complaint on the Electronic Consumer Dispute Resolution platform at http://ec.europa.eu/odr/. Except as provided for in the legal acts of the European Union and the Republic of Lithuania, where Customers have the opportunity to settle disputes in courts of the jurisdiction of their place of residence, disputes arising from the Terms shall be within the jurisdiction of the courts of the Seller's place of residence.
